OfS free speech guidance proposes confidential routes for student concerns

OfS free speech guidance published for consultation on 17 September 2026 proposes confidential reporting routes and qualitative evidence for governing bodies. The Office for Students announcement introduces conditions taking effect in England next April.

What the OfS free speech guidance proposes

The conditions are settled; the accompanying guidance is open to consultation. Condition E11 concerns governing documents and management and governance arrangements. E12 concerns compliance with duties to secure lawful free speech, maintain a code of practice and promote the importance of free speech and academic freedom. The announcement sets 1 April 2027 as the effective date for registered providers; E11 will also apply to registration applicants from then.

The student-feedback connection appears in draft Annex C, page 4. Paragraph 193D suggests confidential routes for students and staff to escalate concerns about coercion, monitoring and harassment affecting free speech. Paragraph 193C suggests governing-body reports, annually or more often, combining qualitative material and data. Examples include complaint timescales, upheld complaints and evaluation of steps to promote free speech.

These are proposed examples, not a compulsory reporting template. The draft makes their suitability dependent on institutional circumstances. The consultation summary invites responses by 23 November 2026, including from students and students' unions.
